1. Agreement to Terms

By accessing or using the PN1 AI Dog Translator application ("App") and website ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and PN1 ("Company," "we," "us," or "our"), located at Donaustraße 44, 12043 Berlin, Germany.

2. Description of Service

PN1 is an AI-powered application that analyzes dog body language and behavior to provide interpretations of your dog's emotions, needs, and intentions. The Service uses artificial intelligence and machine learning technologies to translate canine behavior into human-readable insights.

Important: PN1 is designed for informational and entertainment purposes. It is not a substitute for professional veterinary advice, diagnosis, or treatment. Always consult a qualified veterinarian for health-related concerns about your pet.

3. Beta Program Terms

If you are participating in our beta testing program, the following additional terms apply:

• Beta Software: The beta version is provided "as is" and may contain bugs, errors, or incomplete features. We make no guarantees about the stability or reliability of the beta version.
• Feedback: We encourage you to provide feedback, bug reports, and suggestions. By submitting feedback, you grant us a perpetual, royalty-free license to use, modify, and incorporate your feedback into our products.
• Confidentiality: Beta features and functionalities should be kept confidential and not shared publicly without our written consent.
• Data Collection: During beta testing, we may collect additional usage data to improve the Service. This data is handled in accordance with our Privacy Policy.

4. User Accounts

To access certain features of the Service, you may need to create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

You must be at least 16 years old to create an account. If you are under 18, you must have parental or guardian consent to use the Service.

5. Subscription and Payments

PN1 offers both free and paid subscription plans. By subscribing to a paid plan, you agree to:

• Pay all applicable fees as described at the time of purchase
• Authorize us to charge your selected payment method
• Accept that subscriptions automatically renew unless cancelled

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of your current billing period.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by PN1 and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. You may not:

• Copy, modify, or distribute the Service or its content
• Reverse engineer or attempt to extract the source code
• Use the Service for any commercial purpose without our consent
• Remove any copyright or proprietary notices

7. User Content

You may upload photos, videos, and other content of your dog(s) to the Service ("User Content"). You retain ownership of your User Content, but grant us a license to use, store, and process it to provide the Service.

You represent that you have all necessary rights to upload your User Content and that it does not violate any third-party rights or applicable laws.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, secure, or error-free
• The AI interpretations will be accurate or reliable
• The Service will meet your specific requirements
• Any errors in the Service will be corrected

The AI-generated interpretations are for informational purposes only and should not be relied upon for making decisions about your pet's health or safety.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PN1 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Service interruption or computer damage
• Any damages arising from reliance on AI interpretations
• Any harm to your pet based on information from the Service

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or €100, whichever is greater.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will cease immediately. You may request deletion of your account and associated data in accordance with our Privacy Policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Berlin, Germany.

For consumers residing in the European Union, you may also be entitled to bring claims in the courts of your country of residence.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date.

Your continued use of the Service after any changes indicates your acceptance of the new Terms. We encourage you to review these Terms periodically.
